Can The Mentally Ill Sign Legal Contracts? | Bankrate.com

Can a mentally ill person on Social Security with a payee sign real estate contracts legally?

Dear John,
It's possible, depending on the type and extent of the mental illness. But you're on a rocky road here. As you can imagine, the potential for the abuse of the mentally ill in cases involving home sales is great, as is the possibility that a contract can be voided if signed by someone who is -- or was at time of signing -- considered to not have the "capacity to contract," as the legal world calls it.

Indeed, people who suffer from certain mental illnesses can still have clear understandings of the significance of their actions. For example, a person with a multiple personality disorder who is properly medicated and suffering no symptoms can often be considered to have clear understanding, as can a bipolar person who isn't showing symptoms. But what constitutes that "capacity to contract" has many gray areas, so I strongly recommend you (or whoever is involved in this) get expert consultation, legal advice or both before proceeding with any signings of contracts.

Also, laws defining mental competence vary by state. In most states, the degree to which a person understands the meaning and effect of a contract's wording, otherwise known as the "cognitive test," carries the most weight. However, in other states, an "affective test" is used to determine if a person understood the meaning and effect of the contract's wording, and the other party had reason to be aware of that person's condition. In others, a "motivational test" is used where courts determine if the person in question ever had the ability to judge whether or not to enter into a contractual arrangement.

Typically, the burden of proof in court cases pertaining to this is on the party who claims limited mental capacity. It is not unheard of for a court to decide against such an adult claimant who has not been legally declared incompetent and thus has no legal guardian. In cases of dementia, an ill person who has not executed a durable power of attorney, will or other proxy empowering a relative or another legal authority to handle contracts and other important decisions may have to wait for a so-called good day to read and sign. But sometimes those decisions can come under legal scrutiny by unhappy relatives or other interested parties.

In other words, it is important that all major decisions involving this mentally ill person be done aboveboard. The payee of that Social Security income you're talking about and his or her legal guardian may not be one in the same. It is that guardian who should be carefully considering any potential real estate agreements.

HAM Radio Network to help disaster communications
Thiruvananthapuram, Mar 9 : Steps will be taken to formalise the role of HAM amateur radio network in disaster communications, said Kerala Revenue and Disaster Management Minister Thiruvanchoor Radhakrishnan.

He was responding to a representation made by a member of the HAM radio community on their readiness and availability to act in disaster situations during a discussion on the topic ?Media and Disasters? here today.

Organised in connection with the ongoing international workshop on disaster risk reduction and contingency planning, Surakshaayanam 2012, representatives of the media including Deputy Editor, Frontline Ventikesh Ramakrishnan, Associate Editor of India Today M G Radhakrishnan and Malayala Manorama Bureau Chief John Mundakkayam delineated various aspects of media reportage on disaster management.

Opening the session, Mr Venkitesh, who chaired the discussion, said that media has a role before and during the disaster, disseminating crucial information to the public Mr Radhakrishnan called for sensitising the media on disaster and disaster management aspects and noted that media?s role should be positioned against practicalities including pressures of commercial media and the superfluous nature of mainstream media.

Mr John Mundakayyam said the general perception is that disaster management is seen as a rescue operation and not as a science. Communicating more information on disaster management will enable the public to take preventive measures in future situation.

The speakers highlighted the need for raising media awareness on disaster and management efforts by bridging the gap between media and scientific community, and the use of technology in disaster communications.

Dr K Sekar of the Bangalore-based National Institute of Mental Health and Neuro Sciences spoke on the psycho-social issues said post-disaster mental trauma should not be misconstrued as mental illness. (UNI)

Majhess: We rely on our city to not only provide the vital services we depend upon like public safety, clean water, and sanitation services but also to foster the sense of community that drew each of us to make Boca Raton our home.? Boca is truly a unique place to live and work and it is the duty of our city leaders to protect our community for the benefit of the people they serve.? That means in addition to the vital services I mentioned previously, also the highest caliber of parks and recreation, green space, architectural and building standards, good roads and a commitment to protecting the value and quality of life enjoyed in every neighborhood by every citizen.

Chapman: City government is important due to the fact that is impacts our lives on a more basic level than any other level of government.? City Council is tasked with long term planning in our city, public safety and makes the ultimate decisions that impact our local levels of service and quality of life.? It is my hope my ability to make good, reasonable and sound decisions will to the future success of Boca Raton.

Majhess: The most important thing the city can do is to be good stewards of taxpayer money.? We must keep taxes low and minimize the regulatory burdens of commerce in our city in order to encourage job creation, corporate relocations, and economic development to create jobs.

Chapman: My plan begins with stopping tax increases my opponent has supported because they send the wrong message.? I will champion a proactive recruitment program to attract technology businesses to Boca Raton with incentives and a cooperative approach with the BDB.

How will you, as a council member, vote on the Archstone apartment project proposed for Palmetto Park Road??

Majhess: Since no study was done on the traffic impacts at Palmetto Park Road and 5th Avenue, and no real discussion took place about the planning of the area to include the future of the Waterfront (Wildflower property) and the already approved 220 units on the south side of Palmetto, I voted NO on the project.? The existing Council has been evaluating projects one at a time as if they will exist in a vacuum rather than taking a comprehensive look at the entire region.

Chapman: The project has been approved by a majority of the Council.

What type of development do you want for the Wildflower property?? Would you reconsider a proposal to build apartments there to draw people to downtown??

Majhess: No.

Chapman: First and foremost the site was purchased with taxpayer money, so the public needs access to the waterfront there.? It must not be a high traffic generator and should fit into the low impact character of the barrier island of which it is the gateway.? I do not support apartments there.

To Mr. Majhess: If you are re-elected, how will you be able to work effectively with four members of the City Council who endorse the other candidate?

If re-elected I will continue to work for the PEOPLE of Boca Raton and fight to protect their interest at all times.? (AP) ? Syria's deputy oil minister appeared tense as he looked at the camera and announced in a video that he has defected from President Bashar Assad's regime, acknowledging he expects government forces to "burn my home" and "persecute my family."

Abdo Husameddine, a 58-year-old father of four, on Thursday became the highest-ranking civilian official to join the opposition, and he urged his countrymen to "abandon this sinking ship" as the nation spirals toward civil war.

In the YouTube video, Husameddine seemed to address Assad directly, accusing him of vast crimes in the past year as government forces pummel the opposition with tanks and snipers. The U.N. estimates 7,500 people have been killed since the uprising began.

"You have inflicted on those you claim are your people a full year of sorrow and sadness, denied them their basic rights to life and humanity and pushed the country to the edge of the abyss," said Husameddine, wearing a dark suit and tie. He appeared to be reading from a script, casting his eyes down to find the words.

"I do not want to end my life servicing the crimes of this regime," he said. "I declare that I am joining the revolution of the dignified people."

The authenticity of the video could not be verified, and he did not disclose his location. Damascus did not comment on the video. According to a resume posted on the website of Syrian Oil and Gas News, Husameddine is married with four children, fluent in English and French, and studied petroleum engineering at al-Baath University. He was appointed by Assad in 2009.

Assad's regime has suffered a steady stream of low-level army defectors, who have joined a group of dissidents known as the Free Syrian Army, now numbering in the thousands.

Brig. Gen. Mostafa Ahmad al-Sheik, who fled to Turkey in January, was the highest ranking officer to bolt. In late August, Adnan Bakkour, the attorney general of the central city of Hama, appeared in a video announcing he had defected.

Authorities reported he had been kidnapped and said he was being kept against his will by gunmen. He has not been heard from since.

Civilian officials, like Husameddine, have remained largely loyal ? making his announcement noteworthy.

Open dissent is dangerous in Syria, a country that crushed any rumblings of defiance even before the popular revolt started to threaten the Assad family's 40-year dynasty. The security forces, which are the backbone of the regime and drive the culture of fear and paranoia, will protect the leadership at all costs.

The cohesion is built into the very structure of the government. Assad, and his father who ruled before him, filled key military posts in the overwhelmingly Sunni country with members of their minority Alawite sect, ensuring loyalty by melding the fate of the army and the regime.

As a result, the army leadership will likely fight to the death, out of fear of being persecuted if the Sunni majority gains the upper hand. But it is not only Alawites whose livelihoods are tied up with the regime; many government officials and prosperous Syrian businessman and officials have long traded political freedoms for economic and other advantages.

In many ways, Husameddine's defection was a reminder of just how airtight the regime has remained, particularly compared to the swift hemorrhaging of Moammar Gadhafi's inner circle.

Within weeks of the Libyan revolt last year, a number of Libyan ambassadors and other high-ranking officials quit the government, and many joined the opposition leadership. The early defection of huge sections of the army in eastern Libya gave the rebel movement a safe zone where they could freely organize their political and military strategies.

Syria has seen nothing similar, with armed groups fighting under the banner of the Free Syrian Army but lacking coordination beyond their city or even their neighborhood.

Husameddine appealed to other officials to follow his lead.

"I advise my colleagues who have been silent in the face of crimes for a year to abandon this sinking ship, which is about to drown," he said. "The blood of martyrs will not forgive those who continue to conspire with them under the justification that they are employees or carrying out orders."

He also spoke to the Alawites, saying they have no reason to support the regime.

"I advise the Alawite community and say to them, 'the Syrian people is your safety net, and the regime will doubtlessly go, so don't be partners in killing your people,'" he said.

Husameddine identified himself as an engineer and assistant to the oil minister. He said he was member of the ruling Baath Party, but was now quitting, adding he had served 33 years in various government posts. Cabinet ministers in Syria may have several assistants known as deputies.

U.S. State Department spokeswoman Victoria Nuland said Washington couldn't authenticate the video. But if Husameddine has defected, she said, it would be in keeping with the Obama administration's call "for senior members of the regime to break with Assad, refuse to stand with this brutal dictator, and instead stand up for the dignity of their people."

"So it would be very good news indeed," Nuland told reporters.

Asked about the limited numbers of defections so far, she said "they start with a trickle, and then they tend to turn into a torrent."

"We are seeing an uptick over the last couple of months of military defections. They seem to be in the rank and file primarily," Nuland said. "But once these things get going, they tend to increase. So let us hope that we are at the beginning of a trend."

Husameddine's defection came at the height of international pressure against Assad's regime, with the U.S. considering options for military intervention.

Although there are widespread concerns that military action could cause a regional upheaval, Army Gen. Martin Dempsey, chairman of the Joint Chiefs of Staff, told the U.S. Senate Armed Services Committee that Obama has ordered up a Pentagon review of options.

Dempsey said the options to be examined include enforcing a no-fly zone and humanitarian airlifts. He added that the military would study the situation and report back on points like Syria's sophisticated air defenses and its extensive stockpile of chemical weapons.

The presidents of Turkey and Tunisia, meeting in Tunis, said they are opposed to outside military intervention in Syria. Turkish President Abdullah Gul said regional powers should try to resolve the crisis.

Former U.N. chief Kofi Annan, the new special envoy to Syria, was expected in Damascus on Friday to try to end the violence. He warned against further militarization of the conflict and urged the opposition to come together with the government to find a political solution.

"I hope that no one is thinking very seriously of using force in this situation," Annan said in Cairo. "I believe any further militarization would make the situation worse."

U.N. humanitarian chief Valerie Amos, who on Wednesday got the first independent outside look at the Baba Amr district of Homs following a deadly monthlong siege, said she was struck by the devastation she saw.

"That part of Homs is completely destroyed, and I am concerned to learn what happened to the people in that part of the city," she said in the capital of Damascus, a relatively peaceful stronghold of Assad's regime.

Activists allege that Syrian forces conducted cleanup operations in Baba Amr, including execution-style killings and arrests.

Shortly after she spoke, Syrian security forces opened fire to disperse mourners in Mazzeh, an upscale neighborhood of Damascus, at a funeral of a soldier who was allegedly killed last month for refusing to obey orders to shoot at civilians in Homs.

The British-based Syrian Observatory for Human Rights said scores of people were arrested in Mazzeh. There was no word of casualties.

After seizing Baba Amr, regime forces now appear to be turning their attention to other rebellious areas. Activists are reporting assaults on the northern province of Idlib near Turkey amid fears that could be the next target.

Some Syrians brushed off diplomacy as a waste of time, saying the world should arm those fighting the regime.

"Diplomacy cannot work. We need weapons to get rid of this regime," said Sami al-Din, 27, who was wounded in the southern province of Daraa when regime forces fired on a demonstration. He spoke to The Associated Press in Amman, Jordan, where he and other Syrians were receiving medical care.

"Now power must be met with power," said businessman Fayez Qudeh, 30. "People are being killed day after day and there will be no solution to the Syria crisis without military force."

Romney wins Ohio, 5 other Super Tuesday states

(AP) ? Mitt Romney squeezed out a win in pivotal Ohio, captured five other states with ease and padded his delegate lead in the race for the Republican presidential nomination but was forced to share the Super Tuesday spotlight with a resurgent Rick Santorum.

"I'm going to get this nomination," Romney told cheering supporters in Massachusetts," pointing particularly to delegate support that was greater than the combined totals of his three rivals.

On the busiest night of the campaign, he scored a home-state win in Massachusetts to go with primary victories in Vermont and in Virginia ? where neither Santorum nor Newt Gingrich was on the ballot. He added the Idaho and Alaska caucuses to his column.

Ohio was the big win, though, and the closest contest of all as the Republican rivals battled for the chance to face Democratic President Barack Obama in November.

Santorum countered crisply, winning primaries in Oklahoma and Tennessee and the North Dakota caucuses ? raising fresh doubts about Romney's ability to corral the votes of conservatives in some of the most Republican states in the country.

Ohio was the marquee matchup, a second industrial-state showdown in as many weeks between Romney and Santorum. It drew the most campaigning and television advertisements of all 10 Super Tuesday contests and for good reason? no Republican has ever won the White House without carrying the state in the fall.

After trailing for much of the night, Romney forged ahead in a count that stretched past midnight. With votes tallied in 99 percent of the state's precincts, he led by about 12,000 out of more than 1.1 million cast.

Gingrich had a victory in his column, too ? his first win in more than six weeks. The former House speaker triumphed at home in Georgia, but a barrage of attack ads by a super PAC supporting Romney helped hold him below 50 percent and forced him to share the delegates.

Texas Rep. Ron Paul had pinned his hopes on Alaska as he scratched for his first victory of the campaign season, but he lost that vote to Romney.

Santorum waited until Oklahoma and Tennessee fell into his column before speaking to cheering supporters in Ohio. "This was a big night tonight," he said. "We have won in the West, the Midwest and the South, and we're ready to win across this country."

In all, there were primaries in Virginia, Vermont, Ohio, Massachusetts, Georgia, Tennessee and Oklahoma. Caucuses in North Dakota, Idaho and Alaska rounded out the calendar.

Romney picked up at least 183 of the 419 Super Tuesday delegates at stake. Santorum gained at least 64, Gingrich 52 and Paul 15. About 100 remained to be allocated, and Romney and Santorum appeared in line for many if not most of them.

That gave the former Massachusetts governor 386, more than all his rivals combined, a total that included endorsements from members of the Republican National Committee who automatically attend the convention and can support any candidate they choose. Santorum had 156 delegates, Gingrich 85 and Paul 40. It takes 1,144 delegates to win the nomination at the Republican National Convention in Tampa, Fla., this summer.

The split of the states ensured that the most turbulent Republican presidential campaign in a generation would continue.

Already, the candidates were looking ahead to the next contests, Kansas and Wyoming caucuses on Saturday, followed by Alabama and Mississippi primaries on March 13.

Restore our Future, the super PAC that backs Romney, disclosed a near-$1 million investment for television ads in Illinois, the next big-state primary on the calendar, on March 20. The organization is already airing commercials in Mississippi and Alabama, as is a group that supports Gingrich, although at lower levels.

Ohio Republicans were a party divided, based not only on the popular vote but also on interviews with voters as they left their polling places.

Santorum outpolled Romney among Ohioans with incomes under $100,000, while Romney won among those with six-figure incomes and up. Romney won among working women, Santorum among women who do not.

Santorum won among self-described conservatives, while Romney outpointed his rival among those who said they are moderate or liberal.

Santorum was preferred by the half of the electorate that is born-again. Romney was the favorite among the half of the electorate that said it is not.

In interviews in all the primary states, Republicans said the economy was the top issue and an ability to defeat Obama was what mattered most as they made their Super Tuesday choices.

They also indicated nagging concerns about the candidate they supported, even in Massachusetts, There, one-third of all primary voters said they had reservations, and about three-quarters of those voted for Romney.

Massachusetts is a reliably Democratic state in most presidential elections, but in Ohio, 41 percent of primary voters said they, too, had reservations about the candidate they supported. No Republican has ever won the White House without capturing Ohio.

Gingrich's victory was his first since he captured the South Carolina primary on Jan. 21, and the former House speaker said it would propel him on yet another comeback in a race where he has faded badly over the past six weeks.

Obama, the man they hope to defeat in November, dismissed the almost-constant criticism of his foreign policy efforts and accused Republicans of "beating the drums of war" over Iran. "Those folks don't have a lot of responsibilities. They're not commander in chief," he said. Unopposed for the Democratic nomination to a second term, he stepped into the Republican race with a Super Tuesday news conference at the White House, then attended a $35,800-a-ticket fundraiser a few blocks from the White House.

Ohio was the day's biggest prize in political significance, a heavily populated industrial state that tested Santorum's ability to challenge Romney in a traditional fall battleground. Georgia, Gingrich's home political field, outranked them all in the number of delegates at stake, with 76, a total that reflected a reliable Republican voting pattern as well as population.

Romney, the leader in the early delegate chase, flew to Massachusetts to vote and said he hoped for a good home-state win.

He also took issue with Obama, saying, "I think all of us are being pretty serious" about Iran and its possible attempt to develop nuclear weapons.

Gingrich effectively acknowledged he had scant Super Tuesday prospects outside Georgia, where he launched his political career nearly three decades ago. Instead, he was pointing to primaries next week in Alabama and Mississippi, and he told an audience, "With your help, by the end of next week we could really be in a totally new race."

The polls show the president's chances for re-election have improved in recent months, as the economy has strengthened, unemployment has slowly declined and Republicans have ripped into one another in the most tumultuous nominating campaign the party has endured since 1976.

The former Massachusetts governor campaigned into Super Tuesday on a winning streak. He captured the Washington state caucuses last Saturday, days after winning a little-contested primary in Arizona and a hard-fought one in Michigan. He won the Maine caucuses earlier in February.

The victories helped settle his campaign, which was staggered when Santorum won a pair of caucuses and a non-binding Missouri primary on Feb. 7.

Santorum and Gingrich have vied for months to emerge as the sole conservative alternative to Romney, and they battered him as a moderate who would lead the party to defeat in November.

But Romney, backed by a heavily financed super PAC, countered Gingrich's victory in the South Carolina primary with a comeback win in Florida. Last week, it was Santorum's turn to fall, as Romney eked out a win in Michigan after trailing by double digits in some polls 10 days before the primary.

Santorum's recent rise has translated into campaign receipts of $9 million in February, his aides announced last week.

Even so, Romney and Restore our Future, the super PAC supporting him, outspent the other candidates and their supporters on television in the key Super Tuesday states.

In Ohio, Romney's campaign purchased about $1.5 million for television advertisements, and Restore Our Future spent $2.3 million. Santorum and Red, White and Blue, a super PAC that supports him, countered with about $1 million combined, according to information on file with the Federal Election Commission, a disadvantage of nearly four to one.

In Tennessee, where Romney did not purchase television time, Restore Our Future spent more than $1 million to help him. Santorum paid for a little over $225,000, and Winning our Future, a super PAC that backs Gingrich, nearly $470,000.

In Georgia, where Gingrich acknowledged he must win, the pro-Romney super PAC spent about $1.5 million in hopes of holding the former House speaker below 50 percent of the vote, the threshold needed to maximize his delegate take.

While the day boasted more primaries and caucuses than any other in 2012, it was a shadow of Super Tuesday in 2008, when there were 20 Republican contests.

There was another big difference, a trend away from winner-take-all contests to a system of allocating delegates in rough proportion to a candidate's share of the popular vote.

Sen. John McCain won eight states on Super Tuesday in 2008 and lost 12 to Romney and Mike Huckabee combined. But six of McCain's victories were winner-take-all primaries, allowing him to build an insurmountable delegate lead that all but sealed his nomination

?I?d wager that?s more to do that she and Sharr are going to lunch this afternoon.?? Nodded Turhan gathering together his own lunch, mustamakkara sausages and lingonberry jam.? His wife despised them but they were one of Turhan?s favorites.

The clomp, clomp, clomp of heavy female shoes?signaled?that at last Nadia was descending from her room.

?Finally.? closing the refrigerator door Turhan turned, look at his daughter just entering the kitchen.

?No.? That skirt is much too short.? ?Dr. Sen insisted ?Go change.? looking at the pinstriped skirt Nadia wore with disapproval which reached way above ?her knees, never mind the revealing slit at her right hip.

Turhan groaned, yet?didn?t?offer his own opinion about Nadia?s attire.

Mirrored-glass slanted at a hard right angle, the art piece glistened with beads of water that spurted upward and then cascaded over its smooth surface falling back into a fountain pool.? Sharr thought it perfectly atrocious, likely really expensive.? Pretentious modern art was not his thing.? He waited for his girlfriend at the center of GenKon?s lobby contemplating his reflection in the shiny piece of art, arms crossed over his chest.

Behind Sharr she came up, nuzzled him put her arms up under his angled Falcanian styled trench coat.? They kissed.

?Err you?re grumpy!? Nadia sensed.

Before responding Sharr took a moment to admire his girlfriend?s attire: Short pinstriped skirt, slit up the right revealing a suggestion of tan thigh, brown hair pulled up and pinned back crowning her head and thick strappy heels.? Of course Nadia wasn?t without her black rimmed glasses, the pools that were her almond blue eyes stared into his soul as she pouted at him.

?Maybe a little, yes.? dryly admitted the Phoenix Project leader.

Arching a brow Nadia said: ?Then I take it you quit.? This was good news, at least for her.? Aria wouldn?t be around to rub salt in Sharr?s wounds. ?Hopefully that would in time make him a happy man.

?Yes? Sharr cleared his throat. ??Very little point working a job that I hate. ?Given my recent luck why bother?? he put his arm around her waist.? ?ThunderHawk Enterprises is a go!?

His monetary gain had done little to brighten Sharr?s mood. ?The source of that income appeared to Nadia to cause some resentment in her boyfriend who suddenly found himself rather well off.? ?Think of it like this, you?ll get to do all those things you want thanks to that trust fund from your father.? She leaned against her boyfriend.? ?At least he made provisions for you.?

?Yet I feel like I?ve made a deal with the devil.?

?I was right you are grumpy.? Nadia patted his cheek.? ?You?ve given a chunk of that cash to Vance to let him set up his own lab that?s a good thing.?

?I did.? He deserves it.? Things were indeed inverted, Nadia and Vance Turner in agreement about something.

?My point is, now you?re on the road you want to be, we all are.? Your father can be damned for all his absence.? Nadia hoped to place this windfall into perspective for him.

Taking her chin Sharr said: ?Odd timing that cheque, that letter.? It talks about you and your parents.?

Having read it herself Nadia was more than aware of the letters contents.? True it was strange her family should have been mentioned and as curious an event as it was there was no way to follow-up on where either the cheque or letter had originated.

?It?s very weird, can?t help but think I?m being manipulated.? Sharr?s instincts were working over time regarding this matter.? ?Something just isn?t right.?

?You?re being paranoid ??

?Sorry to interrupt.? Oberon Kreis stepped out of the shadow of the piece of glass artwork that dominated GenKon?s lobby.? ?This must be the man who?s stolen our young Dr. Korelia?s heart.?

Nadia turned and said: ?Oberon I?d like you to meet Roderik Visal.? Leaning her head on Sharr?s arm Nadia told him.? ?Oberon Kreis is Chief of Security here at GenKon.?

Sharr offered his hand, said: ?Nice to meet you Oberon.? He examined the dueling scar that stood out on Kreis?s left cheek it was he knew a mark of a German aristocrat.

?Und great to at last meet you Roderik,? Kreis smiled his wolfish grin taking his brother?s hand.? ?I?ve heard so much about you.? He winked.? ?Nadia can?t stop telling her lab partners how wonderful her boyfriend is.?

?Oh.? That was news Sharr had no idea his girlfriend talked him up so much.? ?Usually I hear about all the wonderful things she and her lab are developing, I suspect though Nadia?s not telling me half the good stuff, corporate secrets and all.?

?Our little corporate secret Dr. Nadia Korelia, we expect great things to come from her rather? unique mind.? Undoubtly the Korelias had shared Nadia?s eugenic nature with this man.? ?A special girl to be sure.? He tossed back his head, let out a belly laugh. ?Treat her well.?

?We?ve got to go see my parents before lunch.? Nadia tugged on her boyfriend.

?Enjoy your meal.? Oberon gave them a respectful military type bow snapped his heels with a clack that echoed in the marble lobby.? All part of the carriage of an expert fencer.

Watching the Security Chief walk away Sharr said: ?Interesting fellow.?

Nadia shrugged glad Kreis was at last gone.? ?So are we taking your car to lunch or mine?? she much preferred to take her own.

Putting his arms on her shoulders waiting for the elevator that would lead to the downstairs lab where Nadia?s parents worked Sharr said: ?We can go in the Hummer, but I don?t think you want the driver hanging around for the after meal activities.? He smiled patting her bottom.

?Does that mean you?re not going to flip out if I drive?? Nadia teased.

?Sure, just don?t act like we?re on the autobahn.? Sharr kissed her cheek.

?But speed is fun!? Nadia purred. ?It?s so funny; you own a car but don?t have a clue how to drive it.? They got into the elevator.

?Hasn?t Oswald recounted for you how he tried to teach me??

?Yeah, I here it didn?t go well.? We can go in the Maserati, I promise to behave.?

Adele's 21 To Mark 23rd Week On Billboard 200

Next week, Adele's unstoppable 21 is set to notch a 23rd non-consecutive week at #1 on the Billboard 200 thanks to sales of 247,000, according to figures provided by Nielsen SoundScan. As the Grammy-winning singer closes in on 8 million sold in the U.S., Adele is on the cusp of tying the high-water marks held by Prince's Purple Rain and the "Saturday Night Fever" soundtrack, which locked down the pole position for 24 weeks.

Despite some complaints about his label allegedly not putting enough product on shelves, Kid Cudi's side project, WZRD, will land at #3 on sales of 66,000.

Nostalgic fans continue to snap up anything Whitney Houston-related, as three of the late diva's albums remained lodged in the top 10. Her greatest-hits compilation hung in at #2 (112,000), while the soundtrack to "The Bodyguard" moved up a notch to #5 (43,000) and her self-titled debut slipped a spot to #10 (25,000). Houston's final album, 2009's I Look to You, was just outside the top 10 at #13 (24,000). Four other titles also charted in the top 50.

Lawyer: Costa Concordia captain wasn't wearing glasses

GROSSETO, Italy --The captain of the wrecked Costa Concordia cruise liner was not wearing his glasses on the evening of the accident and asked his first officer to check the radar for him, the officer's lawyer said on Saturday.

The giant cruise liner capsized off the Tuscan island of Giglio after hitting a rock on Jan. 13, killing at least 25 people. Seven people are still unaccounted for.?

Prosecutors have accused Captain Francesco Schettino of causing the disaster by bringing the multi-story Costa Concordia, carrying more than 4,200 passengers and crew, too close to the shore.?

The ship's first officer, Ciro Ambrosio, and seven other officers and executives of the ship's owner, Costa Cruises, are also under investigation.?

Ambrosio has told investigating magistrates that Schettino, 51, did not have his glasses on when he steered the massive ship within a stone's throw of shore in the dark of night to perform a maneuver called a "salute." Many of the passengers were having dinner at the time of impact.?

"That evening Schettino had left his reading glasses in the cabin and repeatedly asked Ambrosio to look at the radar to check the route," Ambrosio's lawyer Salvatore Catalano told Reuters, quoting his client's testimony to magistrates.?

Schettino has said that the rock hit by the cruise liner was not on his navigational charts.?

The captain has acknowledged that he brought the ship too close to the shore, but he says he was not the only one to blame for the tragedy.?

Catalano said his client was the only officer on the ship's bridge who went ahead and ordered the listing vessel to be evacuated before the captain made up his mind to do it himself.?

"He ordered the lifeboats to be put to sea from deck number four," Catalano said.?

Catalano was speaking in the Tuscan city of Grosseto, where a pre-trial hearing into the disaster took place on Saturday. None of those under investigation attended the hearing, which was held in a theater to accommodate hundreds of victims' relatives, survivors and lawyers for all sides.?

The Costa Concordia, carrying more than 4,200 passengers, ran aground Jan. 13 off the coast of Italy. At least 17 people died in the accident, and rescuers continue to search for others missing.

NBC News reported that more than 4,000 people were invited to attend the hearing. In order to fit everyone in one space the trial was held in the Modern Theater in the coastal town of Grosseto.

The theater was expected to accommodate victims' relatives, survivors and lawyers for all sides, but was not open to the general public or media.

"We are here to look for justice and the truth, rather than compensation. They almost killed us," Giacomo Brignone, a survivor of the accident, told NBC.

"We want to know the truth, what happened, and what we are supposed to do now. That's all we are asking," said Hilaire Blemand, a French national whose 25-year-old son Michael was onboard the ship with his girlfriend Mylene Litzler, 23.

Both are still reported missing.

"It's been too long already, it's been six weeks," he said.

Fighting back tears at his side, Mylene's mother Brigitte Litzler said her anguish had deepened after identification of the bodies was suspended at the request of the lawyer for one of the ship's officers under investigation. He argued forensic experts from the defense team should be part of the process.

"It's like they have killed them a second time," Litzler said. "We are dead inside already; they have killed our kids so we are dead, too. But we won't give up, we will keep returning until we have them back."

During the hearing, the judge appointed various experts to analyze the data from the ship's black box. It could take as long as three months for them to present their findings, public prosecutor Francesco Verusio told Reuters.?

Schettino is accused of a string of charges, including multiple manslaughter and abandoning the 114,500-ton liner before the evacuation of all passengers and crew. He is under arrest at his home in Meta di Sorrento, near Naples, and did not attend the hearing.?

His lawyer, Bruno Leporatti, said he could have been in danger had he decided to attend.

The captain "is a man who has feelings, who is pained over what happened. He feels pain for the victims," Leporatti told Reuters Television.

Neither Schettino, nor his wife, Fabiola Russo, nor his brothers spoke to reporters who sought comments from them at his home on Saturday.?

His presence at the hearing would have been "unnecessary and perhaps with this climate that has been created around him, also a little dangerous for him," Leporatti said.

His neighbors in the sleepy seaside town continued to defend him.?

During a hearing held Wednesday in Washington, D.C., the Coast Guard and Maritime Transportation Subcommittee reviewed U.S. cruise ship safety regulations as well as international safety standards and heard testimony from Costa Concordia cruise ship survivors. NBC's Tom Costello reports.

"It's normal for accidents to happen at sea," Franco D'Elia, a former sailor, told Reuters. "Accidents happen on solid ground, at sea, and in the sky."

Others weren't as sympathetic to Schettino.

"I don't think he has got the guts to show up in front of all the passengers whom he put through all that fear," Adriano Bertaglia, a survivor participating in a class action suit against the company, told Reuters in front of the theater.

The hearing comes after 627 passengers disembarked in the Seychelles on Thursday from another Costa liner, the Costa Allegra, which had to be towed for three days by a French fishing boat in the Indian Ocean after a fire knocked out its engines.

Marco de Luca, the lawyer for Costa Cruises, told NBC: "I think we were unlucky. I don't think anybody can deny that."
